Drug production/cultivation, also known as “production of substance”, includes that not only the accused actually grows or produces the drug, but can also apply to the owner of a property who knowingly allows others to use the property to produce illegal drugs, or to anyone who assist in any way beyond the actual act of production.

The most common charges for drug production/cultivation include:

  • Cultivation of marijuana (Schedule II) – Controlled Drugs and Substances Act Section 7
  • Production of hashish (Schedule II) – Controlled Drugs and Substances Act Section 7
  • Production of cocaine or heroin (Schedule I) – Controlled Drugs and Substances Act Section 7
  • Production of amphetamines, LSD, mescaline, psilocybin (Schedule III) – Controlled Drugs and Substances Act Section 7
  • Production of barbituates or anabolic steroids (Schedule IV) – Controlled Drugs and Substances Act Section 7

The Penalties

Penalties will vary and are dependent on the type of substance and the amount.

Schedule I:

  • Criminal record
  • Up to life imprisonment

Schedule II:

  • Criminal record
  • Jail time of up to 14 years (cultivation of marijuana); Up to life imprisonment (production of hashish)
  • Fine of up to $1000

Schedule III:

  • Criminal record
  • Jail time of up to 3 years
  • Fine of up to $5000

Schedule IV:

  • Criminal record
  • Jail time of up to 3 years
  • Fine of up to $5000
